Hi- I've been told by my sister in Michigan, that they now have a law where if you have sales I believe of less than $3,000 annually, you do not have to produce food out of a licensed kitchen. Any business that generates over $3,000 in food sales, still has to use a licensed kitchen, which means that you can not use your home kitchen. If somebody just has a small amount in sales, then it does not make any sense to build or rent a licensed kitchen. There is somebody that used to make homemade fudge that we sold at our fruit stand, and she was required by the health department to build a separate kitchen, and I am sure that her sales were not huge, Most of the fudge she made was sold at her fruit stand in the summer time.
